                         Major A.H. Seley of this command is hereby detailed to hear and determin all offences which may be brought before him in accordance with the provision of Sect. 7 of an act of Congress approved July 17" 1862.

Charge
Absence without proper leave
Specification in this that Jonas H Roe Sergent of Company M 5" Ill Cav Regt at Black River Miss on or about the 6" day of September 18 did did absent himself from his Company and Regt without proper authority from Said Company and Regt and remain So absent until the 1st day of October 1863 having had granted him a furlough which Said furlough expired on the 5" day of September 1863 all this at Black river on or about 6" September 1863

Before the undersigned Field Officer of the 5" Ill Cav Regt appointed by the Colonel commanding under the provisions of Gen Order No 3.
   Wer deposed for trial and determination of offences committed by men of this command, was araigned Sergt Jonas H Roe of Company M 5" Ill Cav Regt uppon the foregoing Charges and Specifications to which the accused pleads as follows

when the following evidence was produced Captain A S Jessup of Company M 5" Ill Cav being duly sworn, testifies as follows.
Ques -- did Sergt Jonas H Roe of your company have proper leave to go to his home in Illinois on or about the 6"day of August 1863.
Ans. he did. he had a furlough for thirty days. Ques -- did the Said Jonas H Roe return to his company and Regt at the expiration of his furlough.
Ans. -- he did not. Ques. At what time did the Said Roe return to his company.
Ans. on or about the 1st day of October 1863
Ques what was the State of the Said Roes health when he left your company for his home in Illinois on or about the 5" day of August 1863
Ans. it was verry poor. he was verry much reduced and debilitated.
Ques what was the State of Said Roes health when he returned to his company on or about the 1st of October 1863
Ans his health was a goodeal improved, but I do not [think as good] as previous to his sickness

1st Lieutenant Robert Jessup of Company M 5" Ill Cav being duly sworn testifies as follows.
Ques-- did you See Sergt Jonas H Roe at his home in Illinois on or about the 26" day of August 1863. Ans -- I did
Ques -- what was the State of Said Roes health at the time you saw him in Augst / 63
Ans -- he appeared to be quite feble and looked poorly

Jonas H Roe of Company M 5 Ill Cav (the accused) being duly Sworn makes the following Statement.
I was sick all the time I was at home and before my furlough expired I forwarded the proper Surgeons Certificate to the Regt, and I returned to my company and Regt as soon as I was able to travel. I arived to my company the 1st day of October 1863
Finding
The court finds that Jonas H Roe Sergt of Company M 5" Ill Cav Regt, was absent from his company and Regt longer than his furlough permitted him to be. But, find that the accused was sick and returned to his company and Regt as soon as it was prudent for him to travel.
Sentence
I therefore Sentence recommend that he Jonas H Roe Sergt of Company M 5" Ill Cav Regt receive all pay and allowance due him and return to duty
